Illinois Paid Leave
for All Workers Act
Beginning January 1, 2024, most Illinois employers will be required to provide up to 40 hours of paid leave per year to employees under the Paid Leave for All Workers Act. Public school districts organized under the School Code and park districts organized under the Park District Code are excluded.
What's included?
Employees entitled to paid leave will receive one hour of accrued paid leave for every 40 hours worked, up to 40 hours/year.
The Details
- Leave can be used for any purpose and employers cannot require justification.
- Employers who choose to frontload the entire amount of leave at the time of hire or at the beginning of the year are allowed to prohibit the carryover of the leave year to year.
- Employers who allow employees to accrue leave must allow it to carry over every year. The use of such leave may be capped at 40 hours annually.
The Impact
- Employers subject to local ordinances mandating leave on the effective date of the Act are exempt from the Act's requirements.
- Any local ordinances amended or effected after January 1, 2024 must comply with the Act.
- The Act does not change the terms of bona fide collective bargaining agreements in effect on the start date.
- Future collective bargaining agreements can only waive the Act's paid leave requirements through an express, clear, and unambiguous waiver in the agreement.
