Who is Covered?
Employers
Covered
- All private employers with one or more employees
- Those who are self-employed may opt in
Not Covered
- Non-union state and local government employers and public employers who do not opt in to coverage through collective bargaining
Employees
Covered
- All private and certain public sector employees, if coverage is collectively bargained
- Domestic and self-employed workers may opt in
Not Covered
- Non-union state and local government employees and unionized employees and employees of the federal government, a municipality, local or regional board of education, or non-public elementary or secondary school, unless coverage is collectively bargained
Types of Leave
Family
Up to 12 weeks in a 12-month period for caring for a family member or bonding with a new child whether by birth adoption or foster placement
Plus 2 more weeks for incapacitation during pregnancy
Exigency
Up to 12 weeks in a 12-month period for caring for a family member that is injured or has a serous illness during active duty, or has experienced a qualifying exigency due to a family member's call to active duty
Medical
Up to 12 weeks in a 12-month period to care for oneself during a qualifying serious health condition
Safe
Up to 12 days in a 12-month period if you are impacted by family violence that leads to you seeking medical or psychological care, counseling, to get help, or participate in any civil or criminal proceedings, or relocation

Benefit Amount: 95% of a worker’s average weekly wage up to 40 times the state minimum wage, plus 60% of average weekly wage above 40 times the state minimum weekly wage. Maximum weekly benefit = Up to 60 times the minimum wage |
