Requirements

You can fulfill your reporting requirements to the state via My FAMLI+ Employer website or by using paper forms.

Here is a brief overview of the requirements.

Quarterly / Annual Reporting

The Colorado Family and Medical Leave Insurance (FAMLI) Division requires that private plan administrators, like American Fidelity, file a joint quarterly report on all equivalent private plan data. This report includes information about all our Paid Family and Medical Insurance (PFMLI) plans in Colorado, including yours. No action is necessary from you. It is our responsibility to gather this information and file it quarterly for the first three years and yearly thereafter.

Annual Private Plan Attestation (APPA)

Beginning in November 2024 and every November thereafter, employers with approved private plans must annually submit an attestation to the FAMLI Division that their contact information is accurate and their approved private plan continues to satisfy the requirements of the FAMLI Act and its implementing regulations. Failure to submit the annual attestation via the My FAMLI+ Employer website may result in the Division's withdrawal of the private plan approval.

Annual Employee Headcount Requirements

All Colorado employers, including those with approved private PFML plans, must update their Annual Total Employee Headcount in their My FAMLI+ Employer account. (The only exceptions are local government employers who have voted to opt out of the program.)

Key Details:

  • Who Must Submit: All employers with Colorado employees, except local governments that have opted out.
  • What to Include: All employees on payroll nationwide for 20 or more calendar workweeks in the previous year, regardless of full-time or part-time status.
  • Why It's Important: If no updated is submitted, employers will pay the full premium rate for that current year for all employees.

Note: Headcounts do not carry over from the previous year. You must submit a new headcount each year.

Private Plan Maintenance Fees

The Colorado Department of Labor and Employment (CDLE) enforces the rules regarding the FAMLI program for employers using private plans.

Key Details:

  • Maintenance Fee: Employers using an approved private plan must pay a maintenance fee for each Employer Identification Number (EIN) enrolled in a private plan during the entirety of the fiscal year. The fees will be published annually by July 31 on the FAMLI Division's website. Fee increases are capped at 10% per year.
  • Payment Deadline: The state will issue an invoice for the amount to be paid each year. This fee must be submitted via the My FAMLI+ Employer portal.
  • Annual Attestation Reminder: The annual attestation and headcount requirements are separate from the maintenance fee.
